General Terms and Conditions

My Trago 

1. DEFINITIONS

For the purposes of these General Terms and Conditions: 

– RAVEL OFFER: The description of the combined trip that includes all tourist services offered by the ORGANIZER. The TRAVEL OFFER may be modified or altered based on the CLIENT’s preferences or service availability. 

– CONFIRMATION OF THE TRIP: The binding agreement detailing the contracted services, forming the contractual obligation between the ORGANIZER and the CLIENT. Changes to this document require written agreement unless pre-communicated exceptions apply. 

– ORGANIZER: My Trago (C.I.F. [Insert Your CIF Number]), with registered office at [Insert Your Address], Madrid. Contact details will be provided in travel documentation. 

– CLIENT: The individual or entity requesting services, who assumes contractual responsibilities unless otherwise specified in writing. 

– BENEFICIARY: The person(s) enjoying the services, whether or not they are the CLIENT. 

2. LEGAL FRAMEWORK 

These Terms are governed by Spanish consumer laws, including Royal Legislative Decree 1/2007 and Law 7/1998. 

3. CONTRACTUAL FRAMEWORK 

These Terms, available at WWW.MYTRAGO.COM, are incorporated into all travel confirmations and bind both parties. 

4. TRIP CONTRACTING PROCESS 

– A deposit payment and written request for CONFIRMATION OF THE TRIP constitute formal contracting. 

– Full confirmation occurs only after My Trago explicitly notifies the CLIENT. 

– Delays or price increases due to late payments or incomplete data are the CLIENT’s responsibility. 

5. POST-CONFIRMATION MODIFICATIONS

5.1 By My Trago: 

– Unavailable services will be replaced with comparable alternatives. CLIENTs must respond to changes within three days or accept modifications by default. 

– Suppliers (e.g., resorts, airlines) may alter amenities without notice; My Trago is not liable unless the trip’s core is severely affected. 

5.2 By CLIENT: 

– Changes requested by the CLIENT may incur additional fees. Cancellation penalties apply if changes are rejected. 

– Reservations may be transferred to a third party with written notice 30 days prior to departure. 

6. CANCELLATIONS

6.1 By My Trago: 

– Full refunds or alternative trips of equal/higher quality will be offered. 

6.2 By CLIENT: 

– Cancellations incur: 

– Processing Fees: $250 per CLIENT. 

– Supplier Cancellation Costs (as per their policies). 

  – Insurance Claim Fees: $200 if My Trago processes the claim. 

– No refunds for “No Show” scenarios or non-refundable tickets. 

7. SERVICE SCOPE 

– Services are defined in the CONFIRMATION OF THE TRIP. 

– Transportation: Adherence to check-in times, baggage rules, and documentation (e.g., 6-month passport validity) is mandatory. 

– Accommodation: Check-in/out times vary by resort. Early/late requests depend on availability. 

– Meals: Special diets require prior notice. No refunds for missed meals. 

8. PAYMENT & PRICING 

– Prices include taxes, processing fees, and services specified in the CONFIRMATION OF THE TRIP. 

– Exclusions: Optional excursions, non-contracted extras. 

– Price revisions (e.g., fuel, exchange rates) exceeding 8% allow CLIENT termination. 

9. CLIENT OBLIGATIONS DURING TRIP 

– Report service deficiencies immediately to My Trago or providers. 

– Non-compliance with instructions may result in contract termination. 

10. LIABILITY

– My Trago is liable for contractual failures unless caused by CLIENT negligence, third parties, or force majeure. 

– Airline delays/cancellations fall under airline responsibility per EU Regulation 261/2004. 

11. VISAS & DOCUMENTATION 

– CLIENTs must secure valid passports, visas, and health documents. My Trago is not liable for related disruptions. 

12. DATA PROTECTION

– CLIENT data is used for service management and marketing. Third-party suppliers receive necessary data for trip execution. 

– Rights to access, rectify, or delete data may be exercised via written request to My Trago.
